Terms of Service.

1. Who we are

Foundwell (foundwell.ai) is run by INNER LEAD Kajetan Młynarczyk, ul. Złota 75A/7, 00-819 Warszawa, Poland, NIP (tax ID) 5252361409 ("we"). Contact: support@foundwell.ai. These terms apply to everything you buy from us.

2. What we sell

Plans for service businesses. We build your website first and show you a free preview. You pay only if you approve it.

• Hosting ($149 one-time build fee, then $19 a month): your website on your domain with SSL and backups, quote requests sent straight to your email, and fixes if something stops working. Changes to texts, photos or prices are not included.
• Care ($149 one-time build fee, then $49 a month): everything in Hosting, plus one change package a month with up to 10 changes (texts, photos, prices, opening hours, a new section), done within 2 business days, and a monthly report on the leads from your site. An unused package does not carry over.
• Jobs (no build fee, $129 a month): everything in Care, with changes in reasonable scope and no monthly limit, plus 4 Google Business Profile posts and 4 Facebook/Instagram posts a month, ready-to-send review request texts with a link and QR code, ready-to-paste replies to new Google reviews, a monthly check of your Google Maps position against nearby competitors, and one seasonal offer page every quarter.

A change package is one list of changes you send us at once, through the change form or by email. It can cover any pages of your site; we make all of it in one go.

For new businesses (on foundwell.ai/launch):

• Launch Kit ($590 one-time): a website, domain connection, Google Workspace email setup, a lead magnet with a signup form and a 5-email welcome sequence. The first month of hosting is included. Website Care ($79 a month) starts automatically 30 days after purchase; you can cancel it before the first charge.
• 7-Day Playbook ($39): a PDF guide delivered by email.

Customers who bought Website ($497 plus Website Care at $79 a month) or Growth ($190 a month) before 15 October 2026 keep those terms.

Prices are in US dollars. Taxes are added at checkout where they apply.

3. How a project works

Hosting, Care and Jobs:

1. We send you a preview of your new website. It costs you nothing.
2. If you like it, you choose a plan and pay through the checkout link. If you don't, you owe nothing and we delete the preview on request.
3. Before launch you can send up to 3 change packages, each with as many changes as you need. We put the site live within 2 business days of your approval and payment, once your domain is connected. If we are waiting on your answer for 14 days, after at least three reminders, we launch the version you approved.
4. After launch, Hosting covers fixes only, Care includes one change package a month (up to 10 changes), and Jobs has no monthly limit within reasonable scope. Send changes through the change form or by email to support@foundwell.ai.

Launch Kit:

1. You pay through the checkout link and fill in our questionnaire.
2. We send a preview within 3 business days of receiving your completed questionnaire.
3. Up to 3 change packages are included, each with as many changes as you need. Changes must fit the scope above; larger additions are quoted separately.
4. We aim to have everything live within 7 business days of the completed questionnaire. Steps that must be done in your name (buying a domain, opening a Google Workspace account) depend on you, and we send a short guide for each.
5. If you don't reply to a preview within 14 days, after at least three reminders, we treat it as approved and launch it. Your rights under section 7 still apply.

Third-party costs such as your domain (about $12 a year) and Google Workspace (about $7 per user a month) are paid by you directly to those providers.

4. Your part

You confirm that you have the right to use the texts, logos and photos you send us, and that your business and its content are legal. We may refuse or stop work on content that is illegal, misleading or infringes someone else's rights.

5. Ownership

Your domain, email accounts and email list are in your name. Once you have paid, the content we create for you is yours to use. When a plan ends, your website goes offline at the end of the paid month. If you paid a build fee (Hosting, Care, Launch Kit, Website), we send you the website files and texts free on request. On Jobs, where the build was free, we hand over the files for a one-time fee of $199.

6. Subscriptions

Hosting, Care, Jobs, Website Care and Growth renew monthly until you cancel. There is no minimum term. You can cancel anytime by emailing support@foundwell.ai; the cancellation takes effect at the end of the month you have paid for. We do not refund partial months.

7. Refunds

• 7-Day Playbook: full refund within 14 days of purchase, no questions asked.
• Build fee (Hosting and Care): you pay it only after approving the preview. If the site is not live within 10 business days of your payment for reasons on our side, you get the build fee back in full.
• Website and Launch Kit: full refund if you cancel before you approve the preview. After you approve the preview, the work is delivered and the fee is not refundable.
• Fixes after launch: for 30 days after launch we fix anything that doesn't work as agreed (for example a broken link, a form that doesn't send, or emails landing in spam) at no cost, within 2 business days. After that, fixes are included in every monthly plan.
• One extra change package: within 30 days of launch you can send one more change package at no cost, on any plan. Larger changes are quoted before we start.
• If you are a consumer in the EU, these refunds are at least as generous as your statutory right to withdraw from a distance contract within 14 days, and nothing in these terms limits your mandatory consumer rights.

8. Use of AI

We use AI tools to write, design and build. You see a preview and approve everything before it goes live.

9. Liability

We do our work with care but cannot guarantee specific business results, such as a number of leads or sales. Except where the law does not allow a limit (for example for intent or gross negligence, or towards consumers), our total liability is limited to the amount you paid us in the 12 months before the claim. We are not responsible for outages or changes at third-party services such as Google, Stripe, MailerLite or your domain registrar.

10. Law and disputes

These terms are governed by Polish law. Business customers agree that disputes go to the court competent for our registered address. Consumers keep the protection of the mandatory laws of their country of residence.

11. Changes

We may update these terms. Changes do not apply to orders already paid.
